Impact to Federal Gov’t Shutdown – Update

The Centers of Medicare and Medicaid (CMS) informed state agencies that the federal nursing home surveys, revisits, and investigations of medium and low-level harm complaints and facility-reported are no longer paused. 

RCS will resume unannounced federal certification/state licensure surveys, investigations, and revisit activities as normal. Work in Medicaid-only facilities (ICF/IID Facilities and Nursing Facilities) will continue as normal.  Enforcement actions will continue as normal. Residential Care Services (RCS) awaits further instructions from CMS regarding the process for resumption of activities that started just prior to the shutdown and were paused, as well as instructions on next steps for complaints that were paused for federal regulation investigation but still reviewed for state regulations during the shutdown. The iQIES system remains available for use so providers will receive all Statements of Deficiencies (SODs) via ePOC and can return any Plan of Correction (POC) via ePOC.

The federal continuing resolution is passed through January 2026.  Residential Care Services will inform providers of any federal direction that would impact providers, as received from CMS.
