Legal Resources and Support Available Before Formal Discharge

Facilities report that they often work for months to resolve payment, care, or resident representative issues before considering discharge. When a Medicaid resident faces a concrete risk of discharge or transfer, Washington’s Legal Counsel for Long-Term Care Program may be able to provide resident assistance even before a written notice is issued, while capacity permits.

Early legal review can help determine whether an underlying issue is driving a specific discharge risk, such as a disputed Medicaid decision, care needs issue, or a problem involving a resident representative. With the resident’s permission, counsel may communicate with the provider, DSHS, or others to explore whether the issue can be resolved before a formal discharge notice becomes necessary.

Providers may help initiate a referral by calling 888-437-0017 or initiating online intake here: LTCRR Intake Form – Disability Rights Washington. Intake will then follow up independently with the resident or representative to determine whether the resident wants assistance and whether the matter falls within the program.

Program attorneys represent the residents and provide legal assistance. They do not replace case-management services. Post-notice cases remain high priority.
