DSHS Plans Changes to Background Checks Following Passed Legislation

Engrossed Substitute House Bill (ESHB) 1385 focused on implementing the National Crime Prevention and Privacy Compact. DSHS issued a Dear Provider Letter announcing it has filed a CR-101 to change Washington Administrative Codes (WACs) to comply with the new law’s requirements, including:

An individual’s right to receive results within a specified timeframe, and appeal results to challenge the accuracy or completeness of those results

Advising an individual on the procedures for obtaining a change/correction/update to the federal criminal history record

Informing the individual that the results were handled in a way that protects their privacy

Maintaining a signed waiver for each individual
Residential Care Services (RCS) has scheduled live webinars where interested parties can attend and share feedback on the proposed rules.
